Terms of Service

Welcome to MarkPad.

These Terms of Service (“Terms”) govern your use of the MarkPad application, website, and related services operated by bswenapp (“we”, “our”, or “us”).

By downloading, installing, or using MarkPad, you agree to these Terms.

1. About MarkPad

MarkPad is a macOS application that allows users to create, edit, manage, and export markdown or plain text notes locally on their device.

Some features may require a paid purchase or subscription, including but not limited to:

  • Secure Tabs
  • Automatic Backup
  • Future premium productivity features

2. Eligibility

You must comply with applicable laws when using MarkPad.

If you are under the age required by your local laws to enter into agreements, you must use MarkPad with permission from a parent or legal guardian.

3. Local Storage and Data Responsibility

MarkPad currently stores user notes and application data locally on the user’s device.

MarkPad currently does NOT provide:

  • iCloud sync
  • Cloud synchronization
  • Remote backup services
  • Online account storage

You are solely responsible for:

  • Backing up your notes
  • Protecting your device
  • Preventing unauthorized access to your files

We are not responsible for loss of local data caused by:

  • Device failure
  • System corruption
  • User deletion
  • Third-party software
  • Malware
  • Hardware damage

4. Secure Tab Feature

Certain versions of MarkPad may include secure or protected note features using macOS authentication technologies such as Touch ID or system password verification.

While we implement reasonable protections, no software security mechanism is guaranteed to be completely secure.

Users are responsible for maintaining device security and account access protection.

5. Purchases and Subscriptions

MarkPad may offer:

  • One-time purchases
  • Auto-renewing subscriptions

Payments are processed through Apple App Store services.

Subscription management, billing, cancellations, and refunds are governed by Apple’s policies.

We do not directly collect or store your payment card information.

6. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use MarkPad for personal or lawful business use.

You may not:

  • Reverse engineer the application
  • Resell or redistribute the app without permission
  • Use MarkPad for unlawful purposes
  • Attempt to bypass licensing or payment mechanisms

7. Exported Content

You retain ownership of the notes and content you create using MarkPad.

You are solely responsible for:

  • The legality of your content
  • Backup and export management
  • Distribution of exported files

We do not monitor or review your local notes.

8. Third-Party Services

MarkPad may rely on Apple platform services and operating system features.

We are not responsible for failures caused by third-party platforms, including:

  • Apple services
  • macOS issues
  • App Store availability
  • External storage systems

9. Disclaimer of Warranties

MarkPad is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Data preservation
  • Compatibility with all devices or software

10. Limitation of Liability

To the maximum extent permitted by law, bswenapp shall not be liable for:

  • Data loss
  • Lost profits
  • Business interruption
  • Indirect or consequential damages
  • Security incidents caused by user devices or third-party software

Your use of MarkPad is at your own risk.

11. Termination

We may suspend or terminate access to future services or updates if users violate these Terms.

You may stop using MarkPad at any time by uninstalling the application.

12. Changes to Terms

We may update these Terms periodically.

Updated versions will be published at: https://markpad.bswen.com

Continued use of MarkPad after updates constitutes acceptance of the revised Terms.
